C2Rio Tours & Travel INFORMS AND REQUESTS THAT YOU ATTENTIVELY AND CAREFULLY READ THESE SERVICE TERMS ("TERMS"), AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS, RESOURCES AND OBLIGATIONS. BY ACCESSING OR USING THE C2TOURS PLATFORM, YOU AGREE TO COMPLY WITH THESE TERMS AND BE SUBJECT TO THEM:
The terms "C2", "C2.TOURS", "C2TOURS", "C2RIO", "C2RIO TOURS & TRAVEL", "C2RIO VIAGENS E TURISMO", "we" and "our" refer to the company C2Rio Viagens e Turismo Ltda., Registered Number (CNPJ) 05.873.416 / 0001-38 with headquarters at Quitanda Street 60 / 11º floor - Centro - Rio de Janeiro that you are hiring. The terms "You", "yours", and "yours" refer to the user of the services offered by C2 through the C2Tours Platform, as defined below.
C2 is a travel agency and tour operator, which in addition to operating tours in Rio de Janeiro, has developed the C2Tours Platform, which allows a large number of tour service providers (the “Supplier (s)”) to offer and sell tourist services to You, who, in turn, can search for information on sales of activities and tours, accommodation, trips and excursions, in air, water, land, rail and combined, advising, planning and organizing activities associated with the execution of tourist trips or excursions, as well as the organization of programs, services, travel itineraries, individual or in group, program organizing and services related to educational or cultural trips and other tourist services (the “ Tourist Service (s) ”). By using the C2Tours Platform you may compare and book Tourist Services in real time, and purchase them separately or together, assembling and managing your own trip, in accordance with your personal needs (collectively, “C2Tours Services ”).
The C2Tours Platform allows You to set up a dynamic trip, which includes all the Tourist Services You wish to purchase and pay in one transaction for all the Tourist Services selected by You on the C2Tours Platform. You will be able to search for and select different Tourist Services, such as accommodations, tours and tourist activities, transfers, buses and / or any combination between them, performing a single search and reserving as many Tourist Services as you wish. C2 simply acts as an intermediary showing the options available and enabling You to select Tourist Services, Suppliers and combinations of Tourist Services according to your needs.
In order to book a Tourist Service or register a personal account on the C2Tours Platform, you must be at least 18 years old or be the legal representative of an organization or legal entity duly organized and validly existing in accordance with the laws of the country in which you are established, and that is capable of entering into binding contracts. By contracting Tourist Services through the C2Tours Platform, You declare that: (i) you are civilly capable; (ii) You expressly accepts these Terms; (iii) only uses the C2Tours Platform to book or contract Tourist Services for You and / or for other natural person or legal person (s) on behalf of which You are authorized to book or contract Touristic Services; and (iv) all information You provide to C2Tours through the C2Tours Platform is true, accurate, current and complete. C2Tours may make the access and use of the C2Tours Platform, or certain areas or resources of the C2Tours Platform, subject to certain conditions or requirements, such as the conclusion of a verification process, the fulfillment of specific eligibility or quality criteria, internal assessments or your reservation and cancellation history on the C2Tours Platform.
C2Tours acts as an intermediary between You and the Tour Service Providers and may also provide Tourist Services directly to You through its own suppliers. C2Tours is not obligated, directly or indirectly, to perform the Tourist Services offered to You through the C2Tours Platform and is not responsible for any of the Suppliers’ failure to provide the Tourist Services, or any damages caused by suppliers' sole fault. When You contract Tourist Services through the C2Tours Platform, you are entering into a legally binding agreement directly with the Supplier that offers Tourist Services directly to You through the C2Tours Platform, except where the Tourist Service is provided directly by C2Tours.
The policies, terms and conditions of each Tourist Service are established by each Supplier, without the interference of C2Tours, except when such Tour Service is provided by C2Tours and its suppliers. C2Tours, as a mere intermediary, has no interference with the specific conditions established by each Supplier for the performance of the Tourist Services and, consequently, may not change them or bear any responsibility arising therefrom. We clarify that C2Tours has no interference in the charging of penalties by Suppliers or differences in rates, if applicable, which will depend on the policies, terms and conditions informed by each Supplier on the C2Tours Platform.
C2Tours states that its intermediation activity in the commercialization of the Tourist Services offered by Suppliers does not guarantee that the Tourist Services chosen by You do not present risks to your health and your physical integrity or the health and physical integrity of persons who enjoy the Tourist Services contracted by You through the C2Tours Platform. C2Tours is not directly or indirectly liable for the losses and damages that You or those who enjoy the Tourist Services contracted by You may suffer before, during or as a result of the performance of the Tourist Services by C2Tours Suppliers or other Suppliers. C2Tours is not responsible for any events related to acts of God, force majeure and intrinsic conduct practiced by You or those traveling with You, which may occur before or during the execution of the Tourist Services, and that may eventually delay, interrupt or prevent the execution of the contract.
1.2 To place Purchase Orders for Tourist Services on the C2Tours Platform and register an Account on C2Tours, You must provide (i) your personal information, such as full name, date of birth, nationality, number of your official identification document (passport, ID or Driver’s License), your personal social security number (SSN), landline and cell phone number, valid e-mail address, full address and, if applicable, personal information contained in social contracts and powers of attorney, organization or company which You represent or are related to and its information (“Personal Data”), and (ii) bank and financial information, such as your credit or debit card information, such as the name of the credit or debit card holder, billing address, credit card number, card validity, CVV or any other information necessary for You to make payments related to the use of the C2Tours Platform (“Fiscal Data ”), which will be processed directly by the Payment Platform (defined below). Personal and Fiscal information are necessary so that C2Tours can confirm your Purchase Order and issue the corresponding receipt on your behalf. By providing your Personal and Fiscal information and an e-mail address that is qualified to receive any communications related to the use of the C2Tours Platform (“Your E-mail”), You declare that the informed data is current, accurate and true, and is committed to keeping them up to date, if necessary.
1.4 The updating of the Personal Data mentioned in item 1.2, will not affect the Fiscal information provided by You reflected in Purchase Order receipt of the Tourist Services contracted by You through the C2Tours Platform. You can request through the C2Tours Platform, or by e-mail [define], using the number of your Purchase Order, the correction of any Fiscal information provided by You contained in the invoice referring to your Purchase Order, within a period thirty (30) days from the date of issue of the invoice. You may receive an invoice issued by C2Tours or the Tourist Service Provider contracted by You in Your E-mail or you can access it through your Account on the C2Tours Platform, three (3) working days after the provision of the last Tourist Service contracted by You through the C2Tours Platform.
1.5 Your E-mail will always be the means used by C2Tours to contact You and for You to track and / or manage your Purchase Order. Alternatively, at C2Tours' discretion, we may contact You by text message (SMS) or by Whatsapp, at the telephone number You informed when you made your reservation through the C2Tours Platform. Check that your E-mail is correct and pay attention to the information that will be sent by C2Tours to Your E-mail after placing your Purchase Order. We will consider that You became aware of the confirmation of your Purchase Order or of any changes in it by sending such information to Your E-mail or to the telephone number informed by You, either by SMS or Whatsapp. If you do not receive any information from C2Tours in Your E-mail, SMS or Whatsapp after placing your Purchase Order, You may have provided your Personal information with an error. In this case, we suggest that You (i) check the Spam folder of your email provider if there is any email sent by C2Tours, (ii) check on your mobile device if you have received any SMS or Whatsapp from C2Tours, (iii ) if you have registered an Account with C2Tours, log in to your Account with C2Tours to check that Your E-mail and phone number have been correctly informed in your registration and to correct them, if necessary, and / or (iv) contact C2Tours directly via e-mail [define] to confirm your e-mail and phone number. You will be able to manage your Purchase Order through the C2Tours Platform using your Purchase Order number. In case of additional questions, you can call the customer service phone numbers on the C2Tours Platform.
1.6 The C2Tours Platform offers different payment methods for your Tourist Services reservations. The available payment methods will be informed on the C2Tours Platform before the confirmation your Purchase Order. Any and all payment processing services through, or related to, your use of the C2Tours Platform (“Payment Services”) will be provided to You by one or more legal entities contracted by C2Tours (individually and collectively, as appropriate, “Payment Platform” Payments ”). You must be at least 18 years of age and be able to enter legally binding contracts to use Payment Services. By using the Payment Services, You confirm and guarantee that you are at least 18 years old.
1.7 When You book one or more Tourist Services through the C2Tours Platform, the total amount of the reservation may include: (i) the price or fees related to the Tourist Services chosen by You, multiplied by the number of people who will enjoy the Tourist Services together with You (“Tourist Service Fees”), (ii) the management fees relating to C2Tours Services (the “Management Fees”), (iii) a convenience fee charged by the C2Tours business partner (“Tourist Fees” Convenience ”), if You book a Tourist Service through an affiliate of the C2Tours affiliate program (“ C2Tours Affiliate ”), and (iv) all taxes, fees and / or fees possibly applicable to items (i), ( ii) and (iii) above (the “Tourist Service Fees, the Management Fees and the Convenience Fee, together, will be referred here as the“ Total Reservation Amount ”). You are responsible for paying the Total Booking Amount informed on the C2Tours Platform before placing your Purchase Order. Unless otherwise provided in these Terms, the Total Booking Amount is non-refundable.
1.8 Remember that C2Tours also acts as an intermediary for Tourist Services offered by Suppliers and that the amounts corresponding to Tourist Service Fees will be transferred directly to the Supplier by the Payment Platform. C2Tours Affiliates may offer You the convenience of booking Tourist Services in places where You will not have access to a computer and the amounts corresponding to the Convenience Fee will be transferred directly to the C2Tours Affiliate, if applicable.
1.9 The Payment Platform may, temporarily, restrict the availability of Payment Services, or certain services or resources related to them, to carry out maintenance that ensures the proper or improved functioning of Payment Services. The Payment Platform can improve and change Payment Services, and even introduce new Payment Services from time to time. C2Tours is not responsible for the availability or accuracy of the Payment Services, nor for the content, products or services available in those Payment Services.
1.10 When You place an Order for the Purchase of Tourist Services through the C2Tours Platform, You authorize the Payment Platform to collect from You the Total Reservation Amount. Pay close attention to the messages displayed on the C2Tours Platform or sent to Your E-mail, SMS or Whatsapp by C2Tours after the confirmation of your Purchase Order, in which we will inform you about the steps and status of your Purchase Order. The completion of the management of the reservation and / or confirmation of the Purchase Order depends on the full and due payment of the Total Amount of the Reservation for the Tourist Services contracted by You. Until the confirmation of payment of the Total Amount of the Reservation, the Purchase Order will be suspended and may be canceled by C2Tours. Your Purchase Order will be confirmed when C2Tours sends you to an email to Your E-mail address, or by SMS or Whatsapp, to the phone number provided by You, confirming your Purchase Order and sending the electronic ticket (s) or voucher, whichever is applicable, and the invoice for the Tourist Services You have contracted, within the time limit set out in these Terms. You can also access the C2Tours Platform and enter your Purchase Order number to verify that your Purchase Order has been confirmed and print the electronic ticket (s) or voucher, whichever chosen, and the invoice for the Tourist Services You have contracted, when available. The issuance of the electronic ticket or voucher, whichever chosen, expressly and firmly confirms that You and / or third parties will use the Tourist Services contracted by You through the C2Tours Platform and accept the Supplier's conditions and enter into a contract relating to the execution of the Tourist Service directly with the Supplier.
1.11 If your Purchase Order is subject to confirmation, we will inform You by Your E-mail. If your Purchase Order is rejected for any reason (for example, due to insufficient balance on your credit or debit card, lack of availability, variation in the rate etc.), C2Tours will inform you in Your E-mail about the options available if you wish to continue with your purchase or reservation or, if you prefer, cancel your purchase order.
1.12 In some cases, the Supplier may charge You directly for the Tourist Service contracted, without no interference from C2Tours. In such cases, C2Tours will only inform you of this circumstance before You place your Purchase Order and You will receive the electronic ticket (s) or voucher, whichever the case, and the invoice for Tourist Services You have hired directly from the Supplier.
1.13 When You place a Purchase Order with a credit card, You must fulfill the specific requirements established by your credit card issuing bank for your Purchase Order to be paid for and confirmed by your credit card issuing bank. You must take into account that when You provide your Fiscal information to the Payment Platform and place the Purchase Order, You are authorizing us to charge the Total Reservation Amount. If You make a reservation in the installment option and / or by credit card, You must take into account that:
(i) The Management Charges applicable to your Purchase Order may be charged in full on the first installment paid by You by credit card, even if You have chosen to pay in installments for the remainder of the Total Reservation Amount.
(ii) The interest and / or taxes that may be charged to You due to your option to pay in installments will be added to the Total Reservation Amount, which will be divided by the number of installments selected by You for payment;
(iii) If you have contracted life insurance with your credit card issuer to pay the outstanding balance or other charges that affect the Total Reservation Amount, remember to consult your credit card issuer about the term, conditions and costs of such insurance or charges, which have no relation to C2Tours and depend on and / or vary according to what was contracted by You from the issuer or operator of the credit card used to pay the Total Amount of the Reservation. We recommend that you inquire about the conditions of use and interest offered by your credit card before using the payment method in installments on the C2Tours Platform;
(iv) If the specific conditions of the Tourist Service contracted by You allow You to make a cancellation after confirming your Purchase Order, C2Tours will not return or refund and will not be responsible for the interest related to your Purchase Order, since C2Tours does not receive this interest;
(v) The Total Reservation Amount to be payed may be charged in national currency or in US Dollars, depending on whether it is local or foreign installments. If charged in US Dollars, the entry will be made against the international limit of your credit card. In any case, whatever the payment currency, the Total Reservation Amount will be the amount that was informed and accepted by You when You placed a Purchase Order through the C2Tours Platform. Remember that for international operations, some banks and credit card operators impose certain charges, in addition to corresponding taxes, in accordance with applicable foreign law. In addition, your bank may convert prices to the local currency and charge an amount for the conversion. It may happen that the type of exchange used by the bank is different from the one informed in the C2Tours Platform, and you may notice a variation between the amount charged by the bank and the amount informed in the C2Tours Platform. The bank determines the type of exchange and the rates applied to your reservation. You should check this with your bank;
(vi) Each credit card transaction is subject to anti-fraud verification processes. One of them is to make a small charge on your credit card to check the identity and validity of your credit card. The process of charging and reversing this amount can be viewed on your credit card statement and does not generate any additional costs for You. Once your credit card identity and validity are confirmed, this amount will be returned and the entry canceled;
(vii) C2Tours and the Payment Platform reserve the right to deny, at their sole discretion, services to you or to process Tourist Services reservations on your behalf, for any reason, included, without limitation: (i) lack of authorization for the payment of a Tourist Service reservation by the company that issued your credit card; (ii) the inability to verify the authenticity of your credit card; (iii) the inability to verify the credit card holder presented by You; (iv) the existence of a negative history of you with C2Tours or any of its related companies or subsidiaries; or (v) in cases where it is not permitted by applicable law.
2.1 You can find on the C2Tours Platform information regarding rates per person, qualities and characteristics of the Tourist Services you want to contract, in addition to availability, terms of sale, restrictions, cancellation or refund policies (among others), which will be established and offered directly by the Tourist Service Providers, without any interference from C2Tours. As an intermediary, C2Tours will make it available to You, through the C2Tours Platform, all the features and information of the Tourist Services provided by the Supplier to C2Tours. C2Tours only intermediates and manages your Purchase Orders with Suppliers and supports You and the Supplier in the search for solutions in case of an inconvenience. The Payment Platform charges, when applicable, the amount corresponding to the Total Reservation Amount.
3.1 Within a certain period, after providing a Tourist Service, You or other users of the C2Tours Platform may leave a public comment (“Comment”) and make a review (“Evaluation”) of the Tourist Services that you have contracted through the C2Tours platform. Ratings or Comments reflect the opinions of users of the C2Tours Platform and do not reflect the opinion of C2Tours. C2Tours is not and should not be considered as a promoter of the level of the quality of the Tourist Services and / or the qualification or classification of any Tourist Service available on the C2Tours Platform.
3.2 C2Tours does not verify the accuracy of Reviews and Comments which may be incorrect or misleading. Reviews and Comments made by You or other users of the C2Tours Platform must be accurate and may not contain any defamatory or offensive language. C2Tours reserves the right to reject, edit or delete comments from users of the C2Tours Platform if, at the sole discretion of C2Tours, they include inappropriate languages or contents, or that mentions names. It is forbidden to manipulate the Ratings and Comments system in any way, such as instructing a third party to write a positive or negative Comment about a Supplier or user of the C2Tours Platform. Reviews and Comments are part of the public profile of the user or Supplier of the C2Tours Platform and may also appear elsewhere on the C2Tours Platform (as in the C2Tours Platform ad page). We recommend that you read the Comments and Evaluations of other users that will be available on the C2Tours Platform to help You choose the Tourist Services and check whether they fit your needs and expectations.
3.3 The C2Tours Platform may contain links and directions to other Internet sites, resources and promotions of the C2Tours Platform. Links on the C2Tours Platform (in any format) to web pages maintained by third parties, do not constitute a recommendation by C2Tours of any third party, its web sites or their content. C2Tours may also offer tools to allow the interaction between the C2Tours Platform and a third party website, such as a Social Network (as defined below). C2Tours is not responsible for the websites or resources of third parties, and your use of these websites and resources will not be governed by these Terms.
4.1 You must observe the Supplier's specific legislation and rules applicable to the Tourist Service acquired by You through the C2Tours Platform. We inform that Article 49 of the Consumer Protection Code establishes that the consumer can withdraw from the contract, within 7 days from his signature or the act of receiving the product or service, whenever the contracting for the supply of products and services occur outside the commercial establishment, especially by telephone or from home. To exercise your right of repentance mentioned above you must observe the period of 07 (seven) days from the confirmation of the Purchase Order in Your E-mail. To exercise this right, You must inform C2Tours within this period of time of your withdrawal, in writing or by electronic or similar means.
4.2 Notwithstanding your rights mentioned in the previous item, You can request changes, cancellation and / or refund of a Purchase Order through the C2Tours Platform at any time, as long as in accordance with the policy of alteration, cancellation and / or refund of the Tourist Service defined by the Supplier, available on the C2Tours Platform. Before placing a Purchase Order for a Tourist Service through the C2Tours Platform, You must review the conditions and change, cancellation and / or refund policies defined by the Supplier and applicable to the Tourist Service you intend to hire. You must take into account that the conditions and policies for changing, canceling and / or refunding Purchase Orders made through the C2Tours Platform are defined exclusively by the Supplier, without any intervention or interference from C2Tours, and will be available to you for consultation before You place your Purchase Order on the C2Tours Platform. You must take into account that there are Tourist Services in which, due to the Supplier's determination, changes, cancellations and / or refunds of Purchase Orders are not allowed, or are only allowed with restrictions and / or penalties, including in cases of illness, strikes, weather phenomena, etc.
4.3 If You choose to request any change, cancellation and / or refund of your Purchase Order outside the terms and procedures established in the change, cancellation and / or refund policy defined by the Tourist Service Provider contracted by You, C2Tours will carry out the management and follow-up of your request with the Supplier, but both the response times and the final decision will be exclusive of the Tourist Service Supplier contracted by You through the C2Tours Platform.
4.4 You must consider that C2Tours cannot guarantee that the Tourist Service Provider will issue a prompt solution to the matter. The proceedings and the existing special conditions for your requests for changes, cancellations and / or refunds of a reservation confirmed by You are determined by the Tourist Service Providers, who may establish fines or penalties applicable for changes, cancellations and / or refunds requested by You. It should be made clear that the Supplier is not obliged to make exceptions to the terms of the contract entered into with You at the time of confirmation of the Purchase Order by the Supplier, even in proven cases of illness or physical incapacity that may prevent You from enjoying the Tourist service contracted. If the rate offered by the Supplier foresees a penalty charge for making changes, cancellations and / or refunds or does not allow changes, cancellations and / or refunds, the Supplier may charge these amounts or deny the refund of the amounts paid by You.
4.5 You are responsible for any changes You want to make to your Purchase Order made through the C2Tours Platform or directly to C2Tours' customer service (“Booking Changes”). You agree to pay any Service Fees, Management Charges and / or additional taxes related to such Reservation Changes. C2Tours will carry out an on-line and in real time management and follow-up of your Booking Changes request, cancellation and / or refund before the Payment Platform or the Tourist Service Provider, as the case may be. When You request Reservation Changes, you are canceling a confirmed Purchase Order and requesting a new Purchase Order which will be ruled by the conditions applicable at the time You make such change. Therefore, in addition to the applicable penalties in accordance with the change, cancellation and / or refund policy defined by the Supplier on the C2Tours Platform, there may be a fare difference consisting of a value that results from the difference in the Total Reservation Amount originally paid and the new Total Value of the Reservation, according to the fare availability at the moment of the change (the “Tariff Difference”). Remember that tourist fares are dynamic and depend on variables such as advance purchase, travel dates, season promotions and fare restrictions.
4.6 In the case of refunds approved by the Supplier, these may be made by means of a credit or refund of amounts on the same card with which the Purchase Order was made, with the prior authorization of the cardholder. If the payment was made in cash and / or bank transfer, C2Tours will ask for your bank details to make the refund by bank transfer. The terms of refund and / or reversal of values will depend on each Supplier.
4.7 If severe weather conditions become a security risk to You, or prevent a Supplier from performing a Tourist Service that takes place mainly outdoors, the Supplier may cancel the execution of that Tourist Service. The Supplier may also cancel the Tourist Service if there are other conditions that prevent the Supplier from offering the Tourist Service safely. If the Supplier cancels a confirmed Purchase Order, You will receive a full refund of the Tourist Services Fees paid by You.
4.8 Each Tourist Service selected by You through the C2Tours Platform is governed by its own alteration and / or cancellation conditions established by each Supplier and the alteration or cancellation of a Tourist Service does not affect, in any way, the other Tourist Services contracted by You, which will be governed by its own conditions and which must be changed and / or canceled individually whenever the Supplier's conditions permit.
4.9 Management Charges and Convenience Fees charged by C2Tours and C2Tours Affiliates, respectively, are non-refundable. In the event of cancellation of a confirmed Purchase Order for any reason, such Management Charges and Convenience Fees will not be returned to You as they correspond to the services provided. Likewise, if You request a change or cancellation of a Purchase Order, C2Tours may charge additional Management Charges.
5.1 If You need to make a complaint or inquiry, request Booking Changes and/or cancellations of a Purchase Order, request the resubmission of vouchers or tickets and/or download your invoice, You may access the C2Tours Platform with your Purchase Order number or send an email to reservas@C2.Tours.
5.2 If you want to make a complaint, suggestion or consultation, we recommend that You make a detailed description of the facts, attaching a copy of the evidence of the alleged facts, explaining what happened and formulating in clear and simple terms the solution desired by You so that we can review your case more quickly and efficiently. C2Tours will analyze your complaint and respond to You as soon as possible, through Your E-mail. If, when we review the documents submitted by You, we find that your complaint proceeds partially or totally, we will send a notification to Your E-mail containing a corresponding settlement proposal. C2Tours will also be able to offer you an alternative solution, different from the requests made by You. If You agree with the proposal formulated by C2Tours in accordance with the previous item, You must respond to C2Tours email with your consent of the proposal. Once C2Tours has received your consent by e-mail, a customer service agent will contact You to inform you of the payment date and the other conditions for complying with the agreement.
5.3 Changes or cancellations of Purchase Orders made through C2Tours, even if they are ruled by the Tourist Service Providers, must be managed through the C2Tours Platform. In any of the previous cases, the Supplier will forward the request referred to above to C2Tours.
6.3 If You understand that any Supplier or user of the C2Tours Platform with whom you interact, whether online or in person, has acted inappropriately, including, but not limited to, anyone who (i) participates in offensive, violent or sexually inappropriate, (ii) you suspect that he has stolen or stolen you, or (iii) you engage in any other disturbing conduct, you must immediately report that person to the appropriate authorities and then to C2Tours, by contacting us with the station or police station and providing us with the number of the police report, if available. You agree that any police report you make does not obligate us to take any action, other than that required by law, if any.
7.1 You declare and agree that (i) you use the C2Tours Platform and the Payment Platform voluntarily and at your own risk, (ii) you have had the opportunity to investigate the C2Tours Platform, the laws, rules or regulations, that may apply to Tourist Services, and that you are not dependent on any statement of law or fact disclosed by C2Tours with respect to Tourist Services.
7.2 If C2Tours or the Payments Platform carries out verifications of your identity, as permitted by applicable law, we make no guarantee of any kind, express or implied, that these controls will identify previous or future unlawful acts by a user of the Platform C2Tours.
7.3 You agree that certain Tourist Services may carry inherent risks, and that by using these Tourist Services, You and others who enjoy the Tourist Services contracted by You choose to assume these risks voluntarily. You agree that some Tourist Services may carry risks of illness, personal injury, disability or death, and You and the persons who enjoy the Tourist Services contracted by You are free and entitled to assume these risks when contracting these Tourist Services. You and the people who enjoy the Tourist Services contracted by You have full responsibility for your choices before, during and after participating in a Tourist Service. If You take a minor with You to enjoy a Tourist Service, You are solely responsible for the supervision of the minor during the entire execution of the Tourist Service and to the extent permitted by law, You undertake to keep C2Tours exempt of liability and damages related to liability and claims arising from any form of damage, death, loss or injury that occurs to the minor during the execution of the Tourist Service, or in any way related to the Tourist Service.
7.4 The above exemption applies to the maximum extent permitted by law. You may have other rights under the law. However, the duration of the legally required guarantees if applicable, will be limited to the maximum extent permitted by law.
8.1 You acknowledge and agree that, to the maximum extent permitted by law, all risk arising from your access to and use of the C2Tours Platform and the Payment Platform, your reservation of any Tourist Service through the C2Tours Platform, your participation remains and the participation of other people in any Tourist Service contracted by You, or any other interaction that You or the persons participating in the Tourist Services contracted by You have with Suppliers or other users of the C2Tours Platform, regardless if in person or online. C2Tours will not be responsible for any incidental, special, exemplary or consequential damages, including loss of earnings, loss of data or loss of trade fund, service interruption, computer damage or system failure, or the cost of replacing products or services , or for any personal or physical or moral damages or emotional distress arising from or related to (i) these Terms, (ii) your use or your inability to use the C2Tours Platform or the Payments Platform, or (iii) any communications , interactions or services of other people with You or people who use the Tourist Services contracted by You due to the use of the C2Tours Platform, whether based on warranty, contract, wrongful act (including negligence), liability product or any other legal theory, and even if C2Tours has been informed or not of the possibility of such damages, even if a limited solution contained here has not complied its essential purpose.
8.2 Except for our applicable obligations as set out in these Terms, under no circumstances will C2Tours' aggregate liability arising out of, or in connection with these Terms and your use of the C2Tours Platform and the Payments Platform, and in accordance with any Tourist Service, or interactions with any Suppliers or other users of the C2Tours Platform, will exceed the amount paid or due for their reservations through the C2Tours Platform in the period of 12 (twelve) months prior to the event generating the liability, or R$ 100 (one hundred reais), if none of these payments have been made, as applicable. The damage limitations set out above are fundamental elements of the basis of the agreement between You and C2Tours.
10.1 Except to the extent that they can be supplemented by additional standards, guidelines, policies, terms and conditions, these Terms constitute the entire agreement between You and C2Tours, and prevail over any previous oral or written agreement between You and C2Tours and You regarding access and use of the C2Tours Platform.
10.2 These Terms are not and will not be intended to confer any rights or remedies on anyone other than the parties to this Agreement.
10.3 If any provision of these Terms is found to be invalid or unenforceable, that provision will be removed and will not affect the validity and effectiveness of the remaining provisions contained herein.
10.4 The absence of charge by C2Tours in relation to any right or provision of these Terms will not constitute a waiver of such right or provision, unless acknowledged and agreed by us in writing. Except as expressly set out in these Terms, the exercise by any party of any legal remedy under these Terms will be without prejudice to other measures under these Terms or otherwise permitted by law.
10.5 You may not assign, transfer or delegate this Agreement and your rights and obligations acquired here without the prior written consent of C2Tours. Your right to terminate this Agreement at any time remains unaffected.
10.6 This Agreement will be ruled by the laws of the Federative Republic of Brazil. The Parties consent to the jurisdiction of the courts of the city of Rio de Janeiro, thereby waiving any other. Any action related to the Contract must be brought before the courts of the city of Rio de Janeiro, and the Parties irrevocably accept the agreed jurisdiction.
10.7 Unless otherwise specified, any notification or other communications with You permitted or requested by this Agreement will be provided electronically and sent to Your E-mail or by notification through the C2Tours Platform or via mobile message (SMS) .

C2.TOURS LTDA. is a travel agency duly registered at the Ministry of Tourism, CADASTUR Ministry of Tourism under No. 26.012747.10.0002-3, and its activity is regulated by the Law of Travel Agencies No. 12,974, of May 15, 2014.
These Terms and Conditions were made public through Public Deed. C2Tours undertakes that, in the event of future changes, the resulting text will again be taken to public deed and published on the Site.
